Terms of sale
I. Definitions
- Customer – A natural person, legal entity, or organizational unit without legal personality, to which specific laws grant legal capacity, who places an Order within the Store;
- Civil Code – The Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended);
- Regulations – These regulations for the provision of electronic services within the online store;
- Online Store (Store) – The website available at www.smfproject.com, through which the Customer can place Orders;
- Goods – Individual training and consultations presented in the Online Store;
- Sales Agreement – A sales agreement for Goods within the meaning of the Civil Code, concluded between SMF PROJECT and the Customer, using the Online Store service;
- Act on Special Conditions of Consumer Sales – The Act of July 27, 2002, on special conditions of consumer sales and amending the Civil Code (Journal of Laws No. 141, item 1176, as amended);
- Act on Electronic Services – The Act of July 18, 2002, on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended);
- Order – The Customer’s declaration of intent aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of Goods.
II. General provisions
- These Regulations define the rules for using the Online Store available at www.smfproject.com.
- These Regulations are the regulations referred to in Art. 8 of the Act on Electronic Services.
- The Online Store, operating under the address www.smfproject.com, is run by SMF PROJECT SANDRA WILDNER, based in Katowice (40-507), gen. Józefa Sowińskiego 4, NIP: 6272522448.
- These Regulations define in particular:
- the conditions and rules for making electronic reservations of products available within the Online Store;
- the conditions and rules for placing Orders electronically within the Online Store;
- the rules for concluding Sales Agreements using the services provided within the Online Store.
- To use the Online Store, the Customer should independently obtain access to a computer station or terminal device with Internet access.
- In accordance with applicable law, SMF reserves the right to limit the provision of services via the Online Store to persons who have reached the age of 18. In such a case, potential Customers will be notified accordingly.
- Customers can access these Regulations at any time via the link provided on the main page of the www.smfproject.com website and download and print it.
- Information about Goods provided on the Store’s website constitutes an invitation to conclude an agreement within the meaning of Art. 71 of the Civil Code.
III. Rules for using the Online store
- The condition for starting to use the Online store is registration within its framework.
- Registration is done by filling out and accepting the registration form provided on one of the Store’s pages.
- The condition for registration is agreeing to the content of the Regulations and providing personal data marked as mandatory.
- www.smfproject.com may deprive the Customer of the right to use the Online Store and may limit their access to part or all of the Online Store’s resources, with immediate effect, in the event of the Customer’s violation of the Regulations, in particular when the Customer:
- provided false, inaccurate, or outdated data during registration in the online store, misleading or violating third party rights;
- committed a violation of personal rights of third parties through the online store, in particular the personal rights of other customers of the online store;
- engages in other behaviors that will be considered by www.smfproject.com as behaviors inconsistent with applicable law or general principles of using the Internet or detrimental to the good name of www.smfproject.com.
- A person who has been deprived of the right to use the online store cannot re-register without the prior consent of www.smfproject.com.
- To ensure the security of message and data transmission in connection with the services provided on the Website, the Online Store takes technical and organizational measures appropriate to the degree of security risk of the provided services, in particular measures to prevent the acquisition and modification of personal data sent on the Internet by unauthorized persons.
- The Customer is obliged in particular to:
- not provide or transmit content prohibited by law, e.g., content promoting violence, defamatory, or violating personal and other rights of third parties;
- use the Online store in a way that does not interfere with its functioning, in particular through the use of specific software or devices;
- not take actions such as sending or placing unsolicited commercial information (spam) within the Online Store;
- use the Online store in a manner not burdensome to other customers and www.smfproject.com;
- use any content posted within the Online store only for personal use;
- use the Online store in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, and the general principles of using the Internet.
IV. Procedure for concluding a Sales agreement
- To conclude a Sales Agreement via the Online Store, go to the website www.smfproject.com, select individual training and consultations, and take subsequent technical steps based on the displayed messages and information available on the website.
- The selection of ordered Goods by the Customer is made by adding them to the cart.
- When placing an Order – until the “Order and Pay” button is pressed – the Customer can modify the entered data and the selection of Goods. To do this, follow the displayed messages and information available on the website.
- After providing all necessary data by the Customer using the Online Store, a summary of the placed Order will be displayed. The summary of the placed Order will contain information on:
- the subject of the order,
- the unit and total price of the ordered products or services, including delivery costs and additional costs (if any),
- the selected payment method,
- the selected delivery method,
- the delivery time.

- To send the Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory, and press the “Order and pay” button.
- Sending the Order by the Customer constitutes a declaration of intent to conclude a Sales agreement with SMF PROJECT, in accordance with the content of the Regulations.
- After placing the Order, the Customer receives an email titled “Order confirmation,” containing the final confirmation of all essential elements of the Order.
- The agreement is considered concluded at the moment the Customer receives the email mentioned above.
- The Sales Agreement is concluded in Polish, with the content consistent with the Regulations.
V. Delivery
- The delivery of Goods takes place to the address indicated by the Customer during the Order placement.
- The delivery of ordered Goods is carried out electronically unless the Sales Agreement states otherwise.
- The delivery is free of charge.
- The delivery time is from 1 to 14 business days from the day the Customer sends the Order.
- Customers can access these Regulations at any time via the link provided on the main page of the www.smfproject.com website and download and print it.
VI. Prices and payment methods
- The prices of Goods are given in Polish zloty and include all components, including VAT.
- The Customer can pay the price:
- by transfer to the SMF PROJECT bank account,
- by payment card,
- via PayPal.
- by transfer to the SMF PROJECT bank account,
VII. Right to withdraw from the agreement
- The Customer has the right to withdraw from the sales agreement without giving any reason within 14 days.
- The withdrawal period expires after 14 days from the day the Customer acquires the Goods.
- To exercise the right of withdrawal, the Customer must inform SMF PROJECT of their decision to withdraw from this agreement by an unequivocal statement.
- In the event of withdrawal from this agreement, SMF PROJECT will reimburse the Customer for all payments received from the Customer, no later than 14 days from the day SMF PROJECT is informed of the Customer’s decision to exercise the right of withdrawal.
VIII. Complaints regarding Goods
- SMF PROJECT, as the seller, is liable to the Customer who is a consumer within the meaning of Art. 22[1] of the Civil Code, for non-compliance with the Sales agreement of Goods purchased by that consumer, within the scope specified by the Act on special conditions of consumer sales.
- Complaints arising from the violation of the Customer’s rights guaranteed by law, or based on these Regulations, should be directed to smf.project@gmail.com. SMF PROJECT undertakes to consider each complaint within 14 days.
- SMF PROJECT is not the manufacturer of the Goods. The manufacturer is liable under the warranty for the sold Goods on the terms and for the period specified in the warranty card. If the warranty document provides for such a possibility, the Customer can submit their claims under the warranty directly to an authorized service center, whose address is in the warranty card.
IX. Complaints regarding the provision of electronic services
- SMF PROJECT takes actions to ensure the fully correct functioning of the Store, to the extent resulting from current technical knowledge, and undertakes to remove any irregularities reported by Customers within a reasonable time.
- The Customer can report any irregularities related to the functioning of the Store via email to smf.project@gmail.com.
- In the complaint, the Customer should provide their name, correspondence address, the type and date of occurrence of the irregularity related to the Store’s functioning.
- SMF PROJECT undertakes to consider each complaint within 14 days.
X. Final provisions
- The resolution of any disputes arising between SMF PROJECT and a Customer who is not simultaneously a consumer within the meaning of Article 22[1] of the Civil Code shall be submitted to the court having jurisdiction over the registered office of SMF PROJECT.
- The resolution of any disputes arising between SMF PROJECT and a Customer who is a consumer within the meaning of Article 22[1] of the Civil Code shall be submitted to the courts having jurisdiction in accordance with the relevant provisions of the Civil procedure code.
- In matters not regulated by these Terms and conditions, the provisions of the Civil Code, the Act on the provision of electronic services, and other relevant provisions of Polish law shall apply.
